Governor Holiday requests William Marlin to form a government

HARBOUR VIEW – On September 2, 2014, His Excellency the Governor of Sint Maarten, drs. E.B. Holiday, requested William Marlin, to form a new government as formateur.

The Governor, based on the results of two days of consultations, met with William Marlin today, Tuesday, September 2. He requested Marlin to form a new government, based on a majority in Parliament, and consisting of ministers who are committed to the promotion of the wellbeing of Sint Maarten and dedicated to jointly execute a governing accord, to be agreed upon by the coalition partners National Alliance, Democratic Party and United St. Maarten Party.

In addition, the Governor requested the formateur to give priority to the completion of the process towards the establishment of the budget for 2015 and to the promotion of decision making regarding the different reports on integrity of the public administration as well as to the execution thereof.

The Governor further emphasized the importance of the strict observance of the regulatory requirements including the screening criteria, applicable to the appointment for candidate-ministers.

The formateur took the commission into consideration and will inform the Governor regularly during the formation process.

The Governor requested Marlin to present him the final report of the formation process ultimately September 24, 2014. (Contributed by the Cabinet of the Governor)

WINAIR Hires Local First Officers

SIMPSON BAY, SXM AIRPORT - WINAIR has hired four first officers for the upcoming 2014/15 season, WINAIR is especially proud of as this group who will fill the operational needs of WINAIR during upcoming season but is also pleased that these First Officers are native St. Maarteners. Who will after successfully completing ground school In SXM, simulator training in Canada and passing their probation period will become permanent pilots of WINAIR.     

This newest group of flight crew is part of our ongoing commitment to hire local pilots, this type of talent with the required skill sets was not available in the SXM market and WINAIR was forced to go offshore to recruit flight crews. After flight simulator training in Canada these four individuals will continue their training under the guidance of our Chief Pilot and training Captains in SXM with the expectation that they will become Captains flying for WINAIR serving the public of St. Maarten and the destinations we serve.      

WINAIR the National Flag Carrier of Country St. Maarten also offers other exciting careers in aviation such as licensed Air Craft Mechanics, ground equipment mechanics, customer service agents, ramp agents etc, although the public see’s mainly our pilots there are many exciting careers available in aviation.

Royal Islander Club, La Terrasse Staff Receive RCI Diamond Award

MAHO REEF – Royal Islander Club Front Desk Clerk Kimany Bernard and La Terrasse Housekeeping Supervisor Valina Albert are recipients of the 2014 RCI Diamond Award, presented annually by timeshare exchange company RCI, a division of the firm Wyndham Worldwide.

The Diamond Award recognizes their commitment and dedication to their duties and the provision of friendly and excellent customer service to vacationers at the two properties.

The management of Royal Island Club and La Terrasse are very proud of the achievement of Bernard and Albert. They said the two continue to show that teamwork and dedication are the cornerstones of individual and overall company success

Bernard and Albert have demonstrated “the highest level of customer service and impeccable team spirit,” say the resorts.

Bernard has been with Royal Islander Club since 2008. He was a nominee for St. Maarten Hospitality and Trade Association (SHTA) Crystal Pineapple for Excellence award for Employee of the Year in 2013.

Albert joined La Terrasse since its opening in 2003. She was nominated for the Crystal Pineapple for Excellence award for Supervisor of the Year in the trade category in 2013.

Nature Foundation Launches Third Annual Lionfish Derby. Register before September 9th

COLE BAY - The St. Maarten Nature Foundation will be launching its third Lionfish Derby during the month of September. Participants are asked to register with the Nature Foundation before the ninth of September in order to win cash prizes for most lionfish caught as well as special prizes for largest and smallest lionfish caught. There will be a special weighing event on Saturday, the 27th of September where the winners will be announced. The Windward Island’s Bank, Barefoot Terrace and International Liquors and Tobacco have already signed up as sponsors of the event.

The aim of the derby is to get dive operators and registered divers involved in helping to control the lionfish in order to protect the local coral reef ecosystem. “There is a need for experienced divers and local fishermen to control the lionfish for the protection of our local reef species. The Nature Foundation looks forward in having enthusiastic dive instructors take part in the derby in order to help with the Man of War Shoal Marine Park. Fishermen are also continuously contributing to the control of the lionfish by trapping the animal in offshore areas,” according to the Nature Foundation.

Lionfish are an invasive venomous fish that can inflict a painful and sometimes fatal sting. Lionfish are usually found in the Indian and Pacific Oceans but were introduced into the Atlantic thru the aquarium trade. Native fish species do not recognize the Lionfish as a threat so they are unable to defend themselves against it. In other places were lionfish were spotted there are hardly any snappers and grouper left because those are the type of fish the lionfish likes to eat.

Latin American support for regional Ombudsman Offices

PHILIPSBURG - Ombudsman Dr. Nilda Arduin recently attended a Conference of the Latin American Ombudsman Institute (ILO) in Cali Colombia. The importance of this event for the Ombudsman of Sint Maarten is marked by various resolutions taken at the Conference and a subsequent Membership meeting. Together with the Ombudsman of Curacao, President of the CAROA, Alba Martijn, and the IOI Regional Director of the Latin American/Caribbean Region, Lynette Stephenson, Ombudsman of Trinidad, these Ombudsmen of the Caribbean region were formally accepted as Members of the ILO. Membership of the ILO not only broadens exchange and network possibilities with Ombudsmen of the Latin American region, but provides direct access to University reports of researches regarding issues valuable to Ombudsmen of the region.

Dr. Arduin together with the recently deceased Ombudsman of Santa Fe, Argentina, Dr. Edgardo Bistoletti, has been instrumental in bringing the two regions together. This resulted in a Memorandum of Understanding for cooperation between the ILO and CAROA, signed at the Cali Conference. Recognizing the importance of cooperation between the two regions, a personal translator for Dr. Arduin, available for the entire Conference and ILO meeting, was sponsored by the International Ombudsman Institute (IOI). Dr. Arduin is a Director of the Latin American and Caribbean Region on the IOI Board.

Important Declarations and Resolutions for Sint Maarten of the Cali Conference, which will strengthen the local Ombudsman institution, are among others:  that the  experience accumulated by the Institutions of the Ombudsman in Latin America and the Caribbean has highlighted the validity of the need, as well as aspects of the Ombudsman institution that require consideration, research and study; ILO will study the possibility of undertaking joint projects in specific areas among Latin American institutions and the Ombudsman of the Caribbean to favor better reciprocal knowledge and facilitate integration in the work; in consideration of the need to deepen the study of the Institution of the Ombudsman, ILO ratifies its commitment to promote agreements with public and private universities in order to create academic spaces with courses, seminars, and specialized chairs with said purpose; ILO shall continue to support all initiatives in favor of increasing the participation of civil society organizations, not only to have greater impact on public politics, but also in the appointment of officials whose mission is to defend the rights of people.

In 2013 IOI allocated a grant of 35.000 euro for the Latin American/Caribbean region for Ombudsman training in the region to which staff of the Ombudsman Sint Maarten is to attend. The next IOI Board meeting, which will be attended by Dr. Arduin, takes place in October 2014 in Vienna.

UP Leader and Board Say Thank You Sint Maarten and Especially the 6000+ Voters Who Voted UP

PHILIPSBURG - United People’s (UP) Party Leader and Member of Parliament Hon. Theo Heyliger and the UP Party Board would like to thank the people of Sint Maarten for exercising their democratic right to vote on Friday, August 29th when over 14,800 persons made use of their right to vote, bringing the turnout close to 70 per cent.

“I am overwhelmed by the support received where over 6000 voters placed their confidence in the UP Party, making the UP the largest political party in the country.  In 2010 as a new party we quickly became the second largest party, and today we are the largest. GOVERNOR STARTS CONSULTATIONS FOLLOWING ELECTIONS

HARBOUR VIEW – Following the Parliamentary elections of August 29th, 2014, His Excellency Governor Eugene B. Holiday decided to start consultations regarding the formation of a new government.

It is noted that the current government has not tendered its resignation to the Governor. The purpose of the consultations is to promote a smooth transition towards the appointment and installation of a new council of ministers taking into account the results of the elections.

The consultations will commence on Monday, September 1st, 2014 with the leaders of the four (4) political parties - UPP, NA, DP and US - who won seats in Parliament, the Vice-Chairperson of the Advisory Council, the Ombudsman and the President of Parliament.

SHTA – No Lame-Duck Decisions

PHILIPSBURG - The St. Maarten Hospitality & Trade Association (SHTA), the largest business representative on the island, representing over 160 companies in the tourism and trade industry on the island, is concerned about two highly controversial labor issues, the Counterpart Program and the Short-Term Contracts.

It is clear that supply doesn’t meet demand on the labor market, hence a fairly large immigration stream to fill these positions: up until the moment that there are enough qualified nationals to fill all vacancies. In the meantime, the gap between insufficiently trained/skilled local employees and available positions should be addressed by Government by additional education or training. This reflects that St. Maarten either has challenges educating its nationals to match the current demand in labor and/or that St. Maarten suffers from “brain drain”. In either case, the cost of rectifying this cannot be levied unto the private sector.

The Counterpart Program places the burden of training local employees for positions that currently - due to non-availability of qualified nationals - require work permits on the private sector who then, in addition to the non-nationals, also have to hire a counterpart for up to 3 years, thereby unfairly increasing the cost of doing business. This program would be an unbearable financial burden for most medium and/or small businesses, but also not be conducive or attractive for any business to establish their operations on the Dutch side of the island. 

The proposed change to Civil Code, Art. 614.a, which intends to regulate the Short-Term Contracts, prohibits practically all defined  term contracts and will only make the labor market more rigid.

Adopting the two proposals will significantly increase unemployment. According to many (international and local) experts, most recently by Dr. Emsley Tromp, who again commented on this in his 2013 Economic Report, stating that St. Maarten needs to urgently decrease the rigidity in the labor market and lower the cost of doing business.  

Handling labor matters that will have a detrimental effect on our economy, during the time between the elections and the installment of the new Government, also referred to as the “Lame-Duck Sessions”, could be viewed as undemocratic, as no one can be held accountable for any legislation passed during this period. The voters can no longer have their say and Parliamentarians and the Government already on their way out cannot be sent home. Furthermore, it would be outrageous to disregard the amount of opposition against these issues from the Private Sector and the Labor Unions.

 SHTA would like therefore urge the current Government and Parliament to focus their attention on the Annual Accounts for 2011 and 2012 before their last days in office. These are matters that still fall under the responsibilities of the current Parliament, and are already long overdue and should, as stipulated by law, form the basis for a realistic 2015 budget.

Overall winners are UP and US

PHILIPSBURG – The Main Voting Bureau is expected to release additional election results in the coming days.  Voters are very much interested in knowing what the individual vote count is of the individual candidates especially those who will be taking up their seat in parliament.

Out of 21,433 voters, 14,882 made use of their democratic right to vote which accounts for 69 per cent.  There were 303 invalid votes’ casts and 79 blank votes.  Political analysts are hoping that the Main Voting Bureau will explore why there were 382 invalid/blank votes.

The breakdown per political party is as follows: United People’s (UP) Party 6,156 votes; National Alliance (NA) Party 4,011 votes; Democratic Party (DP) 2,398 votes; United St. Maarten (US) Party 1,636 votes; The One St. Maarten Peoples Party (OSPP) 168 votes; and the Social Reform Party (SRP) 131 votes.

The House of Parliament has 15 seats.  The parties that have gained seats in Parliament are: UP (7), NA (4), DP (2) and US (2). The quota for a seat in Parliament was 967.

There were 20 polling stations in total.  The UP Party won in 19 out of 20.  The NA Party won at the Milton Peters College.

In comparison to the September 2010 elections, the UP Party gained 1,220 votes; the NA lost 2,260 votes; while the DP gained 28 more votes.
